The Alabama Supreme Court on Friday reversed the order of a lower court that ruled against a lawyer’s claim that another lawyer caused him to get fired by sending a doctored social media post about George Floyd to his bosses. The lawyer was fired one day after a lawyer from another firm sent his bosses a doctored version of the post.The justices did not take sides on whether lawyer Daniel Flickinger’s claim of “tortious interference with a business relationship” against lawyer Lawrence Tracy King was correct.But the justices said because the screenshot was an altered version of Flickinger’s post, tying it to Flickinger’s law firm, it would be up to a jury to decide if King’s text message was truthful and justified.Floyd’s death received national media coverage and sparked riots and protests across the country, including several Alabama cities.

Under the updated regulations, any lawyer not licensed to practice in the state must disclose that fact in all forms of client-seeking communications that may be viewed by people in the state, including online content. Qualifying offices, including personal residences, must be physical locations, “maintained by the lawyer or law firm where the lawyer or law firm reasonably expects to furnish legal services in a substantial way on a regular and continuing basis.” · The regulations specifically ban speed-reading and tiny-font disclaimers, manipulating internet search keywords to divert clients from competitors. Also among the prohibitions is advertising “no fee unless we win” without disclosing that clients would still pay costs, including court filing fees in cases without recovery, which is different from professional services fees.The new rules, she said, raise concerns about the court trying to control how lawyers run their businesses. “I just feel like we’re getting into the weeds and we’re getting nitpicky,” she said. “Not all of us are making a lot of money, and so maybe some of us can’t afford a full staff, maybe some of us can’t even afford an assistant, and so you’re telling us that now we also have to dole out money for office space?” the attorney added.As an accommodation, the new rules provide that, without a bona fide office, lawyers can say things like “available for consultation” or “available by appointment,” or that the lawyer has a “satellite office,” if those statements are true. Samuel Christopher, growth strategy officer at Beach Law, said the Huntsville-based firm welcomes the new rules. “At Beach Law Practice we believe that these updated rules will enhance public trust, promote accountability, and ensure that legal advertising remains a tool for informed choice, not confusion,” Christopher said in a statement to AL.com.Just over 20,000 lawyers are licensed to practice in Alabama and ads for their services dominate TV screens, highway billboards, and social media.

A partner at Butler Snow, which handles all of the legal work for the Alabama prison system, acknowledged earlier this year that his use of artificial intelligence in a court filing led to erroneous case citations.The trend even has caught the attention of Chief Justice John Roberts, who wrote in the federal judiciary’s year-end report in 2023 that AI tools have the “welcome potential” to help lawyers stretch finite resources. “But any use of AI requires caution and humility,” he wrote. Joe Patrice, senior editor at Above the Law, said trend is growing. “When this first started a couple years ago, I think we all believed it was something that some poor lawyer would fall into, they’d get embarrassed by it,” he said.Patrice said a New York lawyer is among the first to run afoul of AI “hallucinations” received a $5,000 fine. He said penalties in other cases have ranged from about $3,000 to $3,100. They were also ordered to give the order to every attorney in their law office, Butler Snow, a prestigious national law firm.The three lawyers sanctioned work in the Huntsville office.
